1. Who We Are
ChangaRide operates a digital platform that connects private vehicle owners ("Drivers") who are already travelling to a destination with other individuals ("Passengers") who wish to travel the same route. ChangaRide acts solely as an intermediary facilitating the arrangement of cost-sharing between private individuals.
ChangaRide is not a transport company, taxi operator, or public service vehicle (PSV) operator. We do not provide, own, operate, or control any vehicles. We do not employ Drivers or offer transportation services of any kind.
2. Nature of the Service
The service enables:
- Drivers to publish details of journeys they already intend to make in their own private vehicle.
- Passengers to discover and request a seat on those journeys.
- Both parties to agree on a cost-sharing contribution that covers a proportionate share of the Driver's actual journey costs (fuel, tolls, etc.).
The fare displayed on the platform represents a cost-sharing contribution — it is not a commercial price for a transport service. Drivers may not profit from journeys posted on ChangaRide. Any amount collected by a Driver beyond their genuine travel costs would be inconsistent with the purpose of this platform.
3. Eligibility
To use ChangaRide you must:
- Be at least 18 years of age.
- Hold a valid Kenyan phone number for OTP-based verification.
- If registering as a Driver: hold a valid driving licence and all legally required motor vehicle insurance for the vehicle you intend to use.
- Not be subject to a platform suspension or blacklist.
4. Driver Responsibilities
By posting a journey, a Driver confirms and agrees that:
- They are the registered owner or an authorised user of the vehicle.
- The vehicle is roadworthy, properly insured, and licensed under Kenyan law.
- They hold a valid driver's licence appropriate for the vehicle class.
- The journey is one they genuinely intend to make regardless of whether Passengers join.
- They will not use the platform as a substitute for a PSV licence or to conduct commercial hire operations.
- They will treat Passengers with courtesy and comply with all applicable traffic and safety laws.
- They bear sole responsibility for the safe operation of their vehicle and the safety of all occupants.
5. Passenger Responsibilities
By requesting a seat, a Passenger agrees that:
- They will be present at the agreed pick-up point at the agreed time.
- They will pay the agreed cost-sharing contribution to the Driver as confirmed on the platform.
- They will behave respectfully and comply with reasonable requests from the Driver.
- They travel at their own risk; ChangaRide does not guarantee the safety of any journey.
- They are responsible for ensuring their personal property during the journey.
6. Cost Contributions
ChangaRide does not process, hold, collect, or handle any contributions between Drivers and Passengers. The cost-sharing contribution shown on the platform is an indicative amount agreed between the Driver and Passenger; all contributions takes place directly between those parties, outside of and independent from ChangaRide.
The only charges collected by ChangaRide is a non-refundable journey listing fee charged to Drivers when publishing a journey on the platform. This fee covers the cost of listing and is unrelated to the passenger contribution amount or the number of passengers who book.
ChangaRide is not liable for any failure by a Passenger to pay the agreed contribution, or any failure by a Driver to complete a journey. Such disputes are solely between the Driver and Passenger and must be resolved between them directly.
7. Ratings & Trust
After each journey, both Drivers and Passengers may rate each other. Ratings are visible to other users and help maintain community trust. Submitting false or malicious ratings is prohibited and may result in account suspension.
8. Prohibited Conduct
Users must not:
- Use the platform for commercial hire, taxi, or unlicensed PSV operations.
- Post journeys they do not genuinely intend to make.
- Harass, abuse, or threaten other users.
- Provide false identity or contact information.
- Circumvent the platform's safety or rating systems.
- Use the platform while under the influence of alcohol or controlled substances (Drivers).
Violation of these rules may result in immediate account suspension or permanent blacklisting.
9. Limitation of Liability
ChangaRide provides the platform on an "as is" and "as available" basis. To the maximum extent permitted by law:
- ChangaRide is not liable for any injury, death, loss, or damage arising out of or in connection with any journey arranged through the platform.
- ChangaRide is not liable for the acts or omissions of any Driver or Passenger.
- ChangaRide does not warrant that journeys will be completed, seats will be available, or that the platform will be free of errors or interruptions.
Nothing in these terms limits liability for death or personal injury caused by ChangaRide's own negligence, or for fraud or fraudulent misrepresentation.
10. Account Suspension & Blacklisting
ChangaRide reserves the right to suspend or permanently blacklist any account at its discretion, including for: violation of these terms, abuse of other users, fraudulent activity, or conduct that brings the platform into disrepute. Blacklisted users will not be able to generate OTP codes or access the platform. To appeal a suspension, contact us at the address below.
11. Changes to These Terms
We may update these Terms from time to time. Continued use of the platform after any changes constitutes acceptance of the revised Terms. We will indicate the effective date at the top of this page.
12. Governing Law
These Terms are governed by the laws of the Republic of Kenya. Any disputes arising from these Terms or your use of the platform shall be subject to the exclusive jurisdiction of the courts of Kenya.
